Personally guaranteed Sound by the seller without a pre-purchase examination. | WHAT YOU NEED TO KNOW: Horses with a personal guarantee of soundness from their owner can have that guarantee disputed via the auction house. For a buyer to dispute the soundness guarantee, a licensed veterinarian must examine and issue a soundness report by 04:59 PM on the Tuesday following the auction. The auction house will make the final determination based on several factors. ATTENTION: Your definition of Sound and the buyer's definition of Sound may be very different than a veterinarian's medical determination of "Sound." Only a veterinarian can determine if a horse is sound or not. Be aware of the seller's rights when selecting this option and how we handle soundness disputes. Sold as-is with the prior history and medical history provided by a representative | WHAT YOU NEED TO KNOW: A horse may or may not be sound and can be represented as such without guarantee. If you've been to a horse auction before, this is how the vast majority of horse are sold.I understand that all horses will be paid out on the Wednesday following the sale. If an issue arises between the seller and buyer, the payment will be held until the matter is resolved. Horses without a soundness guarantee may be paid out early at the discretion of the sale barn. I agree with these terms.I understand that the Seller’s declaration pertains only to soundness and health. If any claims are made regarding undisclosed drugging of a horse within two days of the sale, payment will be held for a reasonable period to allow time for testing results from a licensed veterinarian. The buyer must provide the auction house with evidence that they are actively working to resolve the issue. If the test returns positive, the Seller will be responsible for the full refund and auction house fees. A negative result will lead to the immediate release of funds to the Seller. I agree with these terms.Horses found to have undeclared health issues can be rejected at any time, including complete removal from the sale. The auction house reserves the right and shall have sole discretion in issuing a full refund should undeclared health issues be found while the horse is still in the auction house's care. I agree with these terms.Horses with strangles (equine distemper) should be quarantined for four weeks after the disappearance of all clinical indicators and quarantined for two weeks if exposed to a positive case. No horse will be accepted for consignment that doesn’t meet these requirements or has visible unhealed sores caused by the disease. Should any action be required related to this section, boarding will be charged to the consigner. Quarantine Boarding at the auction facility will be charged at $35 a day starting the day after the notice is given. Trying to hide a positive case by covering a horse with tack or other items could result in a full auction ban. I agree with these terms.Would you like your horse promoted online? Delving into our terms and conditions will provide further insight, but it's important to understand that once you declare a reserve, it's set in stone. After consigning, reserves can't be increased; they can only be reduced or altogether removed. Within our market, the average selling price for a horse is about $2,000. The realistic tops is $8,000. The larger the reserve the more limited the pool for potential buyers. However, by actively presenting and discussing your horse, you can bolster the prospects of securing a higher price. It's observed that horses set at a reserve of $2,000 or below generally find buyers more swiftly. Horses with appropriate reserves of $2,000 have a high likelihood of selling. For Optimal Representation: •Bareback Photos: Always take photos with the horse bareback; additional shots under saddle can be a bonus. •Essential Angles: Conformation photos should include the following angles: Front, rear, both sides (with the horse’s head straight), feet, and teeth (especially for non-registered horses). Ensure each photo captures the entire horse without cutting off any parts. Photography Tips: •Positioning: For side shots, place your horse on level ground. The camera should be level with the middle of the horse’s body. •Grooming: Present your horse at its best. Groom before photographing. If you’ve just groomed your horse, take conformation photos first, then saddle up. •Lighting: Natural lighting is best. The golden hours—within two hours of sunrise or two hours before sunset—are ideal. •Background: Use a calm, non-distracting backdrop like a plain fence or barn wall. A natural setting without too much clutter can also work. •Safety First: When photographing the horse’s teeth or feet, always prioritize safety. Ensure the horse is comfortable with handling, and stay alert. •Capture the Trot: An image of your horse in a trot offers valuable insights into its gait and movement. Remember, the right picture can make all the difference at an auction. Non-Refundable Auction Fees •Seller Responsibility: If my horse is misrepresented, resulting in a refund, I understand that the fees due to the auction house are still owed and non-refundable. Early Acceptance and Boarding Fees •Early Acceptance: Horses can be accepted before the sale. •Post-Sale Boarding: Horses can also be boarded after the sale. •Boarding Cost: $12 per day per horse •Daily Billing: A new day starts at 12:01 AM. Payment Terms •Payment Availability: Payments will be available for pickup or mailed out on the Wednesday following the auction unless the auction house is made aware of any problems with your horse. •Waiting Period: No payments will be made before the waiting period expires unless directed by management. Halter Requirements and Fees •Halter Requirement for Halter-Broke Horses: •All halter-broke horses must wear a halter from the time they step off the trailer until they leave the property. •Halter Fee: If the halter is removed at any time before the horse leaves the facility, the consignor will be charged a $25.00 fee. Check-In and Preview Requirements •Check-In Deadline: All horses must be checked in and ready for preview by 4:00 PM on auction day or notice given of late arrival. •Arrival Delay: If there is a delay in arrival, notice must be given to the auction house. No Sales/Pass Outs Declaration •Timing: All No Sales/Pass Outs must be declared while the horse is still in the ring. •Final Sale: Once the auctioneer announces “SOLD,” the horse is considered sold unless verbally declared as a No Sale/Pass Out before the horse exits the ring. •Fees: If your horse is a No Sale/Pass Out, all associated fees must be paid before Murphy’s Livestock Auction issues a release for the horse. Mandatory Ring Presentation •Auction Ring Requirement: All horses consigned to Murphy’s Livestock Auction must go through the auction ring. •Private Sale/Withdrawal: The consignor agrees not to privately sell or withdraw any consigned horses unless the horse is injured or ill, in which case a vet release and supporting photo/video must be provided to the office. No Show / Pullout Fee •Fee: A $275 no-show fee will be charged if a horse does not appear or is pulled from the auction after arrival without a vet release and supporting photo/video. •No Substitutions: A horse cannot be substituted or replaced once consigned to the sale. No Alley Trading •Prohibition: All consignments must be processed through the sale ring. Alley trading is strictly prohibited. •Post-Sale Transactions: If a buyer approaches you on Murphy’s Livestock Auction property after the sale, you must notify the main office to change a No Sale/Pass Out to a sale, ensuring proper legal documentation is completed. •Binding Contract: By consigning your horse, you agree to sell it through Murphy’s Livestock Auction.The Final StepNeed Assistance?
